In accordance with Bill 25 and the Privacy Act, R.S.C. (1985), c. P-21, Sylvain Émard Danse (hereinafter “we” or “us”) is committed to respecting your privacy in connection with your visit to our website or the purchase of tickets for shows or donations, whether such services are provided directly by Sylvain Émard Danse or by third-party service providers as described below (the “Ancillary Services”). By accessing, consulting or visiting our Website www.sylvainemard.com, by communicating with us or by accepting to receive e-mails from us, by using our Ancillary Services, you accept the terms of this Policy. The Website and Ancillary Services are collectively referred to as the “Services”.

Purpose of the Policy

The purpose of this Privacy Policy (hereinafter the “Policy”) is to inform you of the manner and purposes for which Sylvain Émard Danse collects, uses and communicates your personal information, the choices you have in this regard and how to access and correct it, if necessary.

Our commitments

We have implemented internal procedures to adequately protect the personal information in our possession, and we review them on a regular basis.

For the purposes of this Policy, “personal information” means any information about an individual that directly or indirectly allows that individual to be identified, such as street address, e-mail address, telephone number and financial information.

We collect, use and disclose your personal information as necessary to provide you with our Services, with your consent or as permitted or required by law. The manner in which we obtain your consent depends on the circumstances, as well as the sensitivity of the information collected. Subject to applicable law, your consent may be express or implied, depending on the circumstances and the sensitivity of the personal information in question. If you choose to provide us with personal information, we will assume that you consent to the collection, use and disclosure of your personal information as described in this Privacy Policy.

Generally, we will ask for your consent at the time we collect your personal information. Where we wish to use your personal information for another purpose not previously identified to you at the time of collection, we will seek your consent prior to using your personal information for that other purpose.

  • • when you purchase a ticket for a show or event, either online or by telephone via the ticket offices managed by our partners (Danse Danse, Agora de la danse, etc.), we may collect: your name and language of correspondence; your contact information, such as telephone number, physical address and e-mail address; information relating to your show or event ticket reservation;
  • • when you contact us (by telephone, e-mail or via the online form), we collect your first and last name, e-mail address, telephone number, postal address, the nature of your request and any other information you provide;
  • • when you subscribe to our newsletter: we may collect your e-mail address, first and last name;
  • • when you complete a survey: your first name, last name and e-mail address, your appreciation of the show or webcast, your interests, your sources of information, your occupation, your date of birth, your mode of transportation;
  • • when you make a donation via Zeffy’s services: we collect your first and last name, e-mail address, telephone number, mailing address, the date and amount of the donation and your date of birth;
  • • when you apply for a position: we may collect your last name, first name, mailing address, e-mail address, telephone number, education level, gender, status, membership or non-membership in a particular group (for equal access purposes), as well as the résumé and cover letter you send us.

We collect your personal information in a variety of ways through our points of contact (box offices of venues where we perform, customer service, website and social networks), including when you reserve and purchase a ticket for a show or event, make a donation, use an Ancillary Service, contact customer service, fill out a survey or respond on our social media accounts or to communications sent to you by email from Sylvain Émard Danse.

Use of cookies and other technologies to collect information

We collect information from your browser when you visit our Web site, including your IP address, browser type and language, access times, the content of any unsuppressed cookies your browser has already accepted from us, and the addresses of Web sites from which you linked to our Web site.

When reserving or purchasing tickets, subscriptions and packages through our partners, the user acknowledges that the ticket offices associated with the venues concerned transmit the personal information shared to Sylvain Émard Danse. The venues in question have adopted measures to protect the confidentiality of personal information when it is shared.

As part of managing their customer relationship, Sylvain Émard Danse may also use a customer’s personal information collected through customer service communications, survey participation, interactions on social media accounts or as a result of receiving emails or visiting the Website.

In any event, we do not share, sell or distribute your personal information with or to unrelated third parties except in these limited circumstances. Personal information may occasionally be transferred to third parties who act for us for further processing in accordance with the purposes for which the information was originally collected or the purposes to which you have consented. Unsubscribing from communications

We will do our best to respond promptly to your unsubscribe request, but please allow us a reasonable amount of time to process your request. Please note that if you do not wish to receive commercial e-mails, we may send you communications about the use, modification or cancellation of some of our shows and events that you have purchased.

Retention of personal information

We will only use, disclose or retain your personal information for as long as necessary to fulfill the purposes for which it was collected and as permitted or required by law. Security of your personal information

We have implemented a combination of physical, organizational and technological measures to ensure the confidentiality of the personal information we hold and to protect it against loss or theft, as well as to prevent unauthorized access, transmission, reproduction, use or modification.

These employees have been trained to handle such information properly and in accordance with our security protocols and strict confidentiality standards. The personal information you provide to us is hosted on computer servers located in Quebec (Canada) and in the United States, the latter having confidentiality rules different from those in your country. If such data is located outside your country, it is subject to the laws of the country in which it is located and may be disclosed to the governments, courts or law enforcement or regulatory agencies of that other country and in accordance with the laws of that other country.

However, our practices regarding your personal information remain, at all times, governed by this Privacy Policy and, where applicable, we will comply with the requirements of the GDPR by providing adequate protection in relation to the transfer of personal information between the EU or EEA and the third country.

Your rights regarding your personal information

Upon written request and subject to proof of identification, you may inspect the personal information we have collected, used or disclosed, as permitted or required by law and/or request its rectification.

You may also withdraw your consent to the communication or use of the personal information collected.

Access to and correction of personal information in your file is free of charge.

If you do not provide the required personal information, we will not be able to establish a customer account for you to proceed with an online or telephone transaction, and you will have to come to our box office to complete your next ticket purchase, ancillary service or donation in cash.

As the case may be, you may have other rights, including as a resident of the European Union, particularly under the GDPR, including: (i) the right to withdraw your consent to processing where processing is based on consent; (ii) the right to object to unlawful data processing, subject to certain conditions; (iii) the right to erasure of your personal information, subject to certain conditions; (iv) the right to request that we restrict the processing of personal information, subject to certain conditions, if you believe that we have exceeded the legitimate basis for the processing, that the processing is no longer necessary, or that your personal information is inaccurate; (v) the right to portability of the personal information you have provided to us in a structured, commonly used and machine-readable format, under certain conditions; (vi) the right to object to decisions made by automated means that have legal or other consequences for you, under certain conditions. Third-party websites and services

This privacy policy applies only to our products and services. It does not extend to websites or products or services provided by third parties. Our website includes social networking buttons and hyperlinks to external sites. When you follow these links away from the site, we are not responsible for the privacy practices of such third parties and encourage you to consult the privacy policies of such third parties before using their websites or products or services.

Data concerning children

Our services are not intended for minors under the age of 14, and we do not voluntarily collect personal information from minors under the age of 14. If you are a minor according to the laws applicable to your place of residence (14 years of age in Quebec), please do not provide us with any personal information without the express consent of a parent or guardian.

If you are a parent or guardian and are aware that your children have provided us with personal information, please contact us. If we learn that we have collected personal information from minor children without verification of parental consent, we will take steps to delete that information from our servers.
